Silverpadas · Last Updated: 14 June 2025 · Effective: 14 June 2025

Please read these Terms & Conditions carefully before using the Silverpadas website or registering for any of our programmes. By accessing this website or participating in a Silverpadas programme, you agree to be bound by these terms. If you do not agree, please do not use our services.

1. Definitions

2. Acceptance of Terms

By submitting an enquiry form, confirming a programme booking or attending a Silverpadas session, you confirm that:

If you are registering on behalf of an organisation, you confirm that you have authority to bind that organisation to this Agreement.

3. Nature and Scope of Services

Silverpadas provides education, information organisation and operational consultancy focused on retirement documentation literacy. Our programmes cover:

Silverpadas does not provide personalised financial advice, pension calculations, legal representation or any regulated service under Malaysian law. Nothing in any Silverpadas programme or communication constitutes advice on pension entitlements, investment decisions or legal rights. Where such matters arise, participants are referred to appropriately qualified practitioners.

Programmes are primarily delivered in Perak, Malaysia. Delivery outside this area is at Silverpadas's discretion and subject to separate agreement.

4. Programme Enrolment and Booking

Participation in a Silverpadas programme is confirmed upon receipt of a written booking confirmation from Silverpadas. Submission of an enquiry form does not constitute a binding booking. Silverpadas reserves the right to decline any booking at its discretion.

For the Records Reconstruction Workshop Series, maximum cohort size is ten participants. Places are allocated on a first-confirmed basis. For the Community Organisation Capability Build, a scoping conversation is required before a booking is confirmed.

5. User Responsibilities

You agree to:

You must not use this website or our services for any unlawful purpose or in a way that infringes the rights of others.

6. Intellectual Property

All Content — including handouts, worksheets, templates, curriculum materials and website content — is the intellectual property of Silverpadas unless otherwise stated. You are granted a limited, non-exclusive, non-transferable licence to use Content for personal or internal organisational purposes connected with your participation in a Programme.

Organisations completing the Community Organisation Capability Build are granted a separate licence to reproduce the Silverpadas bilingual materials library for use within their own community programmes, as set out in their engagement agreement. This licence does not include sub-licensing to third parties or commercial use.

You may not reproduce, sell, publish or create derivative works from Silverpadas Content without prior written consent.

7. Fees and Payment

Programme fees are as published on the Silverpadas website at the time of booking and are denominated in Malaysian Ringgit (RM):

Payment terms are confirmed in the booking confirmation. Fees are due in full before the commencement of the programme unless otherwise agreed in writing. Accepted payment methods are confirmed during the booking process.

Cancellation and Refunds

8. Programme-Specific Terms

Introductory Talk

The hosting organisation is responsible for providing a suitable venue, seating and audio equipment where required. Silverpadas will confirm logistical requirements in advance. The talk covers general information only; no personalised assessments are made during the session.

Records Reconstruction Workshop Series

Participants are expected to attend all four sessions. Missed sessions cannot be individually refunded. Materials and personal files assembled during the series remain the property of the participant. Facilitators do not retain copies of participants' personal employment or pension records.

Community Organisation Capability Build

The engagement proceeds only after a written governance and boundary framework has been agreed between Silverpadas and the organisation's own advisers. The organisation is responsible for ensuring its volunteers operate within the boundaries defined in that framework after the engagement closes.

9. Disclaimers

All Silverpadas programmes and Content are provided for general educational and information purposes only. They do not constitute financial, legal, pension or investment advice, and no specific outcome, entitlement or financial result is implied or promised.

10. Limitation of Liability

To the fullest extent permitted by Malaysian law, Silverpadas's total liability to you for any claim arising from these Terms or from participation in a Programme shall not exceed the fees you paid for the specific Programme to which the claim relates.

Silverpadas shall not be liable for any indirect, consequential, incidental or special loss, including loss of income, loss of data or economic loss, even if advised of the possibility of such loss.

Silverpadas is not liable for acts or omissions beyond its reasonable control, including natural disaster, government action, power failure or telecommunications disruption.

11. Indemnification

You agree to indemnify and hold harmless Silverpadas, its facilitators and staff from any claim, loss, cost or liability (including reasonable legal fees) arising from your breach of this Agreement, your misuse of Silverpadas Content, or any representation you make to a third party attributing regulated advice to Silverpadas.

12. Termination

Silverpadas may terminate your access to any programme or this website with immediate effect if you breach any material term of this Agreement. Upon termination, your licence to use Content ceases. Sections 9, 10, 11 and 13 survive termination.

You may withdraw from a confirmed programme at any time, subject to the cancellation and refund terms in Section 7.

13. Dispute Resolution and Governing Law

These Terms & Conditions are governed by the laws of Malaysia. Any dispute arising from or in connection with this Agreement shall first be addressed through good-faith negotiation between the parties. If unresolved within 30 days, either party may refer the matter to mediation under the Malaysian Mediation Centre before commencing legal proceedings.

The courts of Malaysia shall have exclusive jurisdiction over any dispute that proceeds to litigation.
